THE FOLLOWING PROMOTION IS INTENDED FOR VIEWING IN THE UNITED STATES ONLY AND SHALL BE CONSTRUED AND EVALUATED ONLY ACCORDING TO UNITED STATES LAW. DO NOT PROCEED IN THIS SITE IF YOU ARE NOT LOCATED IN THE UNITED STATES.
DESCRIPTION OF CONTEST: The Extreme Gaming Tour Modding Contest (the “Contest”) is a quest to find the coolest, most exciting modification of a PC Chassis. Via online entry, entrants will be required to complete an Official Online Entry Form and provide a user name, original color photograph(s) of their PC Chassis’s modifications and a statement explaining the modifications. All eligible entries will be posted (photos, statement, user name) for online voting. The ten (10) entries with the most points from the online voting will then be judged by the Contest judging panel. From among those ten (10) entries, the judging panel will determine one (1) Grand Prize winner, one (1) First Prize winner, and one (1) Second Prize winner. The Grand Prize is an Area-51® Desktop Computer, the First Prize is a Dell™ XPS™ 630 Desktop Computer, and the Second Prize is a Dell™ SP2208WFP 22 inch Widescreen Flat Panel Display Monitor.
ELIGIBILITY: Participating entrant must be 18 years of age or older and a legal resident of one of the 50 United States (includes DC) at the time of entry. Employees of Dell Inc. (“Dell”), Intel Corporation (“Intel”), Alienware Corporation (“Alienware”), GMR Marketing LLC (“GMR”), and each of their respective parent companies, subsidiaries, affiliates, sales representatives, agencies, retailers, wholesalers, distributors, and promotional and other vendor agencies involved in the promotion, and the immediate relatives (defined for the purposes of this Contest as spouse, child, sibling, parent) and those residing in the households of all such employees, are not eligible. The Contest is void where prohibited or restricted by law.

HOW TO COMPETE: No purchase necessary to enter, play, or win. Potential entrants may enter online at www.extremegamingtour.com by completing an Official Online Entry Form including name, address, daytime and evening telephone numbers, e-mail address, the entrant’s extremegamingtour.com user name, verifying entrant is 18 years of age or older at time of entry and acceptance of the Official Contest Rules, Publicity Release and License of Rights, and the Dell, Intel, and Alienware Privacy Statements. In the areas provided as part of the online entry process, each potential entrant must (i) upload at least one (1) but no more than four (4) original digital color photograph(s) of the modifications done to the outside of the PC Chassis and (ii) submit a statement in 250 words or fewer explaining the modifications (i.e., what has been modified, how was it modified, the inspiration behind the modifications, etc.) (collectively, the “Materials”). Only external modifications visible in the photograph(s) will be considered. Photographs should illustrate all sides of the PC Chassis. Internal modifications will not be considered. No black and white photographs will be accepted. Entries will be accepted between 12:01 a.m. Central Time (“CT”) on July 11, 2008 and 11:59 p.m. CT on August 31, 2008 (“Promotional Time Period”). All entries must be submitted by 11:59 p.m. CT on August 31, 2008 to be considered. Internet entries will be screened for compliance with Contest requirements and criteria (see Criteria for Entries section below); non-complying entrants are not eligible. Dell Inc. (“Dell”), Intel Corporation (“Intel”), Alienware Corporation (“Alienware”), GMR Marketing LLC (“GMR”), and their affiliates and representatives are not responsible for lost, late, or misdirected entries. Incomplete and reproduced entries are void. Limit one (1) entry per person. If you have special needs within the meaning of the Americans with Disabilities Act, and require assistance to participate in the Contest, please call GMR at (262) 780-6164. As condition of entry, participants grant full license to Dell, Intel, and Alienware a perpetual, irrevocable, and fully sub licensable worldwide, royalty-free and non-exclusive license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display the Material (in whole or in part) and to incorporate such Material into other works in any format or medium now known or later developed for any and all commercial or non-commercial purposes. Completed licensing agreement may be required as a condition of being named a Finalist or Grand, First, or Second Prize winner, or Finalist status or prize will be forfeited and an alternate Finalist, Grand, First, or Second Prize winner may be chosen.
CRITERIA FOR ENTRIES: Entrants must provide as part of entry (1) a complete Official Online Entry Form; (2) at least one (1) but no more than four (4) original digital color photograph(s) of the modifications done to the outside of the PC Chassis; and (3) a statement in 250 words or fewer explaining the PC Chassis’s modifications (i.e., what has been modified, how was it modified, the inspiration behind the modifications, etc.). Only external modifications visible in the photograph(s) will be considered. Photographs should illustrate all sides of the PC Chassis. Internal modifications will not be considered. No black and white digital photographs will be accepted. The photograph(s) submitted as part of entry must be entrant’s original photograph(s) and may not have been previously published or submitted in any other Contest. Entries cannot defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third party’s personal or proprietary rights, including, but not limited to, copyright, trademark, and patent licenses, with the exception that any trademarks or logos applied to equipment by the original manufacturer may be retained. Entries that contain any prohibited elements will be disqualified. Any modification of an existing photograph, computer/electronically altered photographs or any other modification of a photograph taken by the entrant does not qualify as an original photograph(s). The photograph(s) must include the entrant’s PC Chassis and the entrant’s original modifications submitted as the entrant’s Contest entry. Entries that exceed specified word limits will be disqualified. Entries must be consistent with Dell’s, Intel’s, and Alienware’s reputation in the marketplace and must be suitable for audiences of all ages. Entries which, in the judges’ or Sponsors’ sole discretion, contain any type of vulgarity or objectionable content will be disqualified.
ONLINE VOTING TO DETERMINE TEN (10) FINALISTS: All valid entries will be featured at www.extremegamingtour.com between approximately 12:01 a.m. CT on September 5, 2008 and 11:59 p.m. CT September 26, 2008 (“Voting Period”) for online voting to determine ten (10) Finalists. To be eligible to vote, consumers must register online at www.extremegamingtour.com and proceed to the Contest’s voting site. Each day, registered consumers will have the opportunity to vote on each posted entry. For each posted entry, consumers will vote “diggin’ it,” which will award the entry one (1) point or “not diggin’ it” which will award the entry a negative one (-1) point. Consumers will only be able to vote once (1) per day per entry during the Voting Period. Non-compliance will result in all of the consumer’s votes being disqualified. Consumers do not have to vote on all entries posted. The ten (10) entries receiving the most points during the Voting Period will be deemed the Finalists. In the event of a tie in voting, the entries involved will be evaluated by a judge from Dell and/or Intel who will break the tie by applying the Grand Prize judging criteria (see Grand Prize Judging Criteria and Selection Section below).
GRAND PRIZE JUDGING CRITERIA AND SELECTION: After the ten (10) Finalists have been determined during the Voting Period, judges will determine the Grand, First, and Second Prize winners based on criteria set forth below. Judging will take place on or about September 29, 2008. The judging panel will consist of marketing representatives from Dell, Intel, and GMR. All entries will be evaluated on a 50 point scale, as follows: a maximum of ten (10) points for the entry’s overall design; a maximum of ten (10) points for the entry’s creativity, including, but not limited to, the imagination, unusualness, and out-of-box nature; a maximum of ten (10) points for the paint job/artwork used in the entry’s modification including, but not limited to, the quality of the design, color usage, and imagery; a maximum of ten (10) points for the engineering of the entry, including the technical enhancements; and a maximum of ten (10) points for the lighting incorporated into the entry’s modifications. The entries with the three (3) highest point totals upon completion of judging will be deemed the potential Grand Prize winner, First Prize winner, and Second Prize winner, respectively, provided that any entry may be eliminated, regardless of point total, in the judges’ or Sponsors’ sole discretion (i) if it is not consistent with Dell’s, Intel’s, and/or Alienware’s reputation in the marketplace, including its reputation for quality and integrity, (ii) if it does not reflect the goals of the Contest, (iii) if the language of the entry is not suitable for all ages, or (iv) if the entry is unclear or inappropriate. In the event of ties in point totals among Finalists, judges will revisit the tied entries and choose as the Prize winner the entry or entries (as needed) that best reflect all criteria as a whole. The potential Grand, First, and Second Prize winners will be notified on or about October 2, 2008 by phone and/or express mail to the address and telephone information listed on the Official Online Entry Form. To become the Grand, First, or Second Prize winner, each potential winner must respond within five (5) calendar days of first attempted notification, (a) comply with the “License of Rights” provisions of these rules, below; (b) complete an Affidavit of Eligibility, Publicity Release, and Mutually Agreeable Liability Release and any required tax documents. Proof or verification of identity and qualification may be required. Failure to comply may result in disqualification and selection of another potential Prize winner, time permitting. The Prize winners will be announced and posted at www.extremegamingtour.com on or about October 11, 2008.
PRIZES AND APPROXIMATE RETAIL VALUES: Odds of winning depend on the number and quality of entries received.
One (1) Grand Prize: One (1) Alienware Area-51® Desktop Computer with Intel® Core™2 Extreme processor. Monitor not included. Total Estimated Approximate Retail Value (“ARV”) of Grand Prize is $2,549.
One (1) First Prize: One (1) Dell™ XPS 630 Desktop Computer with Intel® Core™2 Duo processor. Monitor not included. ARV of the First Prize is $1,149.
One (1) Second Prize: One (1) Dell™ 2208WFP 22 inch Widescreen Flat Panel Monitor (model and all options and aspects to be determined solely by the Sponsors). ARV of the Second Prize is $339.
The total ARV of all prizes awarded in the Contest is $4,037.
Sponsors reserve the right to substitute prize of the same approximate retail value. Any and all guarantees and warranties for merchandise prizes are subject to the manufacturer’s and/or service provider’s terms and conditions, and winners agree to look solely to such manufacturers and/or service providers for any warranty or guarantee claim. All federal, state, and local taxes and fees are the sole responsibility of the winner. Prize consists only of items specifically listed as part of the prize. Prize is not transferable; no prize substitution or cash alternative is allowed except by Sponsors due to unavailability of prize. Prizes will be shipped within 6 to 8 weeks following winner confirmation.
PUBLICITY RELEASE. By registering for this Contest, providing a user name and submitting the Materials, and in consideration of the Contest opportunities provided, entrant irrevocably grants permission for Dell, Intel, Alienware, GMR, and their affiliates and subsidiaries to use entrant’s name, image and/or likeness, biographical information, and the Materials in any medium forever and throughout the world for editorial, educational, promotional, publicity, advertising, or any other purpose on behalf of Dell, Intel, Alienware, and their affiliates, respective licensees and assigns, partners or media without further compensation. Entrant represents and warrants s/he owns all right, title, and interest in the Materials, including but not limited to all copyrights.
LICENSE OF RIGHTS: Entry submissions and Materials will not be returned. By posting, uploading, inputting, providing, or submitting the Materials, entrants specifically grant to Dell, Intel, and Alienware a perpetual, irrevocable, and fully sub-licensable worldwide, royalty-free and non-exclusive license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display the Materials (in whole or in part) and to incorporate the Materials into other works in any format or medium now known or later developed for any and all commercial or non-commercial purposes. Entrant specifically grants permission for Dell, Intel, Alienware and GMR to post the Materials and user name on a Web site for public viewing and voting.
ONLINE REGISTRATION: If for any reason the Contest, including the online portion, is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause that corrupts, affects, or compromises the administration, security, fairness, integrity, proper conduct, or intended play of the Contest, Sponsors reserve the right at their sole discretion to disqualify any individual Sponsors or GMR deems responsible and Sponsors further reserve the right to cancel, terminate, modify, or suspend the Contest, with appropriate alternate method of prize award selected. Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. Sponsors are not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any e-mail or entry to be received by Sponsors due to technical problem or traffic, congestion on the internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSORS RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Contest entries or consumer voting generated by a script, macro, or other mechanical or automated means are ineligible and will be disqualified. All Contest entries must include a valid e-mail address for the entrant. In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of the entry. The “Authorized Account Holder” is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
ADDITIONAL RULES: Entry constitutes acceptance of all rules. All federal, state and local laws and regulations apply. Entrants assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or their redemption or use of their prize. Sponsors provide no warranty of any kind for prizes. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of the judges, whose decisions are final. Sponsors are not responsible for any typographical or other error in the printing of this offer, administration of the Contest or in the announcement of prizes, including an erroneous announcement that may incorrectly imply that a prize is to be awarded. In the event Sponsors are prevented from continuing with this Contest, or the integrity and/or feasibility of the Contest is severely undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction (each a “Force Majeure” event or occurrence), Sponsors shall have the right, in their sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Contest without further obligation. If Sponsors in their discretion, elect to abbreviate the Contest as a result of Force Majeure event, Sponsors reserve the right, but not the obligation, to award the prize from among all eligible entries received up to the date of such Force Majeure event.
RELEASE: By entering and in consideration of the Contest opportunities provided, including any prizes awarded, entrant agrees to release and hold harmless Dell, Intel, Alienware, GMR, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.
